Health Data in the Cloud - Legal Challenges and Protection of Patients
During our stay at the Brocher Foundation, we will pursue the following specific objectives: • A survey of the academic literature on cloud computing and the protection of health data, privacy, confidentiality as well as questions of access and ownership on EU level, selected European countries and the US, with a specific focus on the rights attached to patients; • Identification of key themes, debates and unexplored questions in this literature; • A look into the question whether the existing statutory protection, in particular existing data protection laws on EU level, selected European countries and the US with regard to cloud computing and health data, privacy, confidentiality as well as questions of access and ownership is satisfactory and if not, what alternative concepts are available; • Consideration of the implications of this literature for the task of developing a regulatory framework or guidelines for health data protection and cloud computing in Europe.
